  1. Actually, there is another legal distinction – training is something you may do with employees; you cannot train contractors. If you train them, you are in danger of miscategorizing with the IRS. Learning and education may be offered, not required, to independent contractors. I know companies who require independent contractors to take their offerings, and still call them contractors. However, after much research and discussion with Texas Employment Commission attorneys, they do appear to be legally liable.
